Disability Caregivers Struggling Financially, Emotionally

A nationwide survey of caregivers of those with developmental disabilities is offering new evidence this week of the hardships many families face in accessing support services.

The results of the survey released Tuesday in a report from the Arc show one in three families are on waiting lists for some type of government-funded service ? ranging from personal assistance to respite care and housing ? and they?re likely to remain in limbo for an average of over five years.

The survey, which was conducted last year, culled responses from nearly 5,000 caregivers from across the country.

Most adults with developmental disabilities are living with their parents and have no alternate housing plans for the future, the findings indicate. the majority lack high school diplomas and 85 percent are unemployed.

Their parents are feeling taxed financially and emotionally. one in five families said someone had to quit their job in order to provide care. And more than 80 percent of caregivers said they put their own retirement in jeopardy because they used savings to fund services for a loved one.

What?s more, the vast majority of caregivers report feeling tired and stressed some or most of the time. nearly half say they have more caregiving responsibilities than they can handle, according to the report.

?the future is uncertain for these individuals and their families,? said Peter Berns, CEO of the Arc, who called the situation a ?train wreck waiting to happen.?

To ensure the health of its newest star, the zoo brought in Wellington Hospital specialist John Wyeth to help with the procedure, New Zealand Press Association reported.

Monday's surgery went well, and doctors removed about half of the remaining sand and several twigs from the bird's digestive system, zoo spokeswoman Kate Baker said. Medical staff hope the rest of the debris will pass naturally, but an X-ray is scheduled for Wednesday.

"It's positive news, but he's definitely not out of the woods yet," Baker said.

The penguin is now dining on fish slurry and has been standing and appearing more active than when it arrived, Baker said. The bird was moved to the zoo Friday after its health worsened on the beach.

The penguin is being housed in a room at the zoo chilled to about 46 degrees Fahrenheit (8 degrees Celsius), Baker said, and has a bed of ice on which it can sleep.

Happy Feet, nicknamed from the 2006 animated movie, was discovered last week on a North Island beach, the first spotting of an emperor in New Zealand in 44 years. Emperors typically spend their entire lives around Antarctica.

After landing on Peka Peka Beach last week, the penguin appeared health at first, but it became dehydraded, suffered heat exhaustion and was eating large amounts of sand.

What's next for Happy Feet still remains to be decided.

Peter Simpson, the program manager of diversity for the Department of Conservation, said he is meeting with penguin experts Wednesday at the zoo to consider options. He said it's not simply a matter of tossing the penguin back into the ocean off New Zealand's coast.

"There's no great rush to decide," Simpson said. "It will most likely need more medical work over the next three months."

Simpson said the penguin will likely remain at the zoo for that time while it recovers.

Gareth Morgan, a New Zealand investment adviser, has offered to transport the penguin back to Antarctica next February when he leads an expedition to the southern continent. But Simpson said that, while officials appreciate the offer, they may want to act before then.

Simpson said the penguin may be older than experts first thought ? perhaps up to 2 1/2 years old rather than the initial estimate of 10 months. It stands about 3 feet (80 centimeters) high.

Experts still don't know if it's a male or female, Simpson said, although DNA samples should soon provide an answer.

Global Warming or Little Ice Age: Which Will It Be? (LiveScience.com)

Our sun may be on the verge of a relatively long snooze, as researchers have found solar energy output could decrease in the coming decades. Though the dip in solar activity isn't expected to reverse climate change and plunge Earth into a cold snap, similar phenomenon have happened in our planet's history, scientists say.

Some researchers say that changes in sun activity caused the "Little Ice Age" from 1500 to 1800 ? during the chilliest part of this cooling trend beginning in 1645, the sun reached its 75-year Maunder Minimum, when astronomers found almost no sunspots. But the connection between solar activity and Earth's climate remains largely mysterious ? scientists are not sure how much of a role the Maunder Minimum played in fueling the little ice age.

And despite media claims in recent days that global cooling is imminent, experts don't expect a repeat of the little ice age anytime soon.

"It turns out this would be a very minor impact on the climate, even if we were to return to Maunder Minimum conditions," climate scientist Michael Mann, of Pennsylvania State University, told LiveScience. "That would only lead to a decrease in about 0.2 watts of power per square meter of the Earth's surface ? that compared to greenhouse forcing, which is more than 2 watts per meter squared. That's a factor of 10 larger." [The World's Weirdest Weather]

Predicting solar activity

When researchers refer to solar activity, they generally mean the number and intensity of sunspots, which are dark, cool, magnetically twisted areas on the sun that sometimes erupt violently and send streams of charged particles into space. This activity ebbs and flows in an 11-year cycle.

Even while approaching the next peak in the cycle, a typically storm period called solar maximum that's due in late 2013, the sun seems?to be entering a decreased solar output phase, new research has suggested, one that might all but eliminate sunspot activity during the next cycle, which hits its maximum again in 2022. The data supporting this come from three separate analyses of sunspot activity, solar jet streams and the magnetic field.?

"I'm skeptical of all three pieces of evidence that were presented," said Doug Biesecker, of NOAA's Space Weather Prediction Center, who notes that the data is based on only a few years of observations. "We know the sun doesn't behave exactly the same way all the time, so give the sun a chance to show its normal behavior before we say it's abnormal."

Fewer sunspots would mean lower sun activity in general, the researchers who presented the work believe; and they expect fewer of the suns' intense bright spots called faculae, which ring the sunspots. This decreased brightness would lower the amount of energy that reaches the Earth from the sun. But by how much is an open question.

A new Little Ice Age?

The Little Ice Age that began in the 1500s could have been caused by decreased solar output of just 0.2 percent, previous research by Peter Foukal suggests, though he believes that there were most likely other, earthly factors (including several erupting volcanoes) at play as well.

"If it really were true that the sun were to descend into a period of literally no sunspots for tens of years, there's a possibility that what occurred in the 17th century could occur again," Foukal, of HelioPhysics Inc., told LiveScience. "But we can't be sure there is a causal effect, we can't say for sure why it happened in the 17th century."

Foukal believes that the effect of a solar minimum could help mitigate some of the global warming we are experiencing, though he warns that eventually the minimum will end. "It could mitigate partially if the sun does cool things a little bit, but it's a matter of time before the sun comes back to life again [and] you will roast," Foukal told LiveScience.

Even if the sun has reached a new low point in its cycle, the change in solar output would not be nearly enough to undo even the current warming we've already experienced from increased greenhouse gasses in the atmosphere, Mann said.

Predicting solar output

Researchers have a tough time predicting changes in solar output, though scientists include in their climate simulations the little information they have about solar changes. The known 11-year-cycle is already built into their climate predictions, though it's difficult to know how active any given cycle will be.

A paper published last year by Georg Feulnerand Stefan Rahmstorf? (of the Potsdam Institute for Climate Impact Research in Potsdam, Germany) in the journal Geophysical Research Letters tried to use these models to predict what would happen if the sun did actually enter a new Maunder Minimum starting in 2030. The model found the numbers that agreed with those quoted by Mann ? a decrease of 0.2 watts of power per meter, which is the equivalent of 0.2 degree Fahrenheit (0.1 degree Celsius) of cooling.

"The influence of the grand solar minimum is to decrease the effect of the greenhouse gasses by a few tenths of a degree," Mann said about the results of that study. "How much of a player compared to other drivers that we know are important? It's almost down in the noise, it's a blip on the radar screen."

The sun and the Little Ice Age

While admitting that a small decrease in warming could happen, Mann doesn't agree that it could send Earth into another Little Ice Age. "It's ludicrous, there is no scientific support for that whatsoever," Mann said. "The science doesn't even remotely support that conclusion."

Mann believes that the temperature changes during the Little Ice Age were mainly caused by several volcanic eruptions during that time, which changed the temperatures and dynamics of the atmosphere, causing localized cooling.

Changes to the jet stream also affect local temperatures, as it moves cooler air upward across Europe. The jet stream is dependent on ozone levels in the atmosphere, which in turn can be affected by either solar radiation or by volcanic output in the atmosphere. The debate still rages as to how big of an effect each of these factors play.

BEIJING ? A close friend of recently released Chinese artist Ai Weiwei says officials have released Ai's colleagues after more than two months of detention.

Liu Xiaoyuan said Saturday that Ai confirmed to him that driver Zhang Jinsong, accountant Hu Mingfen and designer Liu Zhenggang were released around the same time Ai was.

Liu Yanping, a volunteer who works with Ai and a friend of another detainee, Wen Tao, says Wen has also been released.

Ai, who challenged the government before his detention, was one of the most prominent activists detained in China's recent crackdown on dissent.

He was detained April 3 and released Wednesday after confessing to tax evasion. Ai says he is not allowed to talk about his case, but his family and supporters dispute the charge.

Andrew Gunther: E. Coli and the Misuse of Antibiotics

When it comes to food and farming, unfortunately it often takes a major public health scare to bring about necessary changes in policy and practice. Unless you have been on another planet you will have no doubt heard the news of the horrific food poisoning outbreak in Europe which has killed 24 people and left almost 2,500 sick.

At the time of writing the exact source of this E. coli outbreak is still not known, although almost all cases have occurred in Germany or were directly linked to travel there. But while the primary focus remains identifying the source of the outbreak and treating those affected, scientists have already expressed alarm at the fact that this particular strain of E. coli -- E. coli O104:H4 -- is resistant to several classes of important antibiotics. And the consensus is that one of the most likely reasons for the development of this multiple-resistant strain is the misuse of antibiotics in intensive livestock farming systems.

As if this devastating E. coli outbreak isn't already damning enough, last week a paper from Cambridge University scientists in the Lancet Infectious Diseases journal confirmed the emergence of a new strain of MRSA with multiple resistance to key antibiotics in British dairy cows, which can cause life-threatening illness in humans. Again, the scientific consensus is that the cause is the routine use of antibiotics in dairy farming, which are used to treat the cattle health problems associated with very high levels of milk production per cow.

So how did we get to this point -- and what can we do about it now?

Whether it is dairy, beef, pig or poultry, almost all intensive farming systems rely on the routine use of low-dose antibiotics to maximize productivity at the lowest possible cost. These low doses of antibiotics are not given to animals because they are actually sick, but because they are managed in a way that encourages diseases to thrive. If you keep beef cattle in crowded feedlots and give them high levels of grain in their diets they are very likely to get stressed, reducing their natural immunity to diseases, and increasing the risk of liver abscesses, bloat and acidosis.

This might not be enough to kill them, but it certainly doesn't make them feel great. As a result, their growth rate will drop -- meaning less profit for the intensive farm. Giving a daily dose of antibiotics in the feed or water counters the unhealthy effects of the farming system and keeps the animals alive and growing. And this is happening on a vast scale: During 2009 alone, the U.S. Food and Drug Administration (FDA) revealed that 80 percent of all antibiotics produced in the U.S. were used for animals -- that's an incredible 28,820,000 pounds out of the 36,080,000 pounds produced.

The problem is that this regular administration of antibiotics can lead to a situation where the level of antibiotic is not high enough to kill all the bacteria and instead a small number survive with resistance to the drug. These antibiotic resistant strains can then pass on this resistance to other bacteria, which spread to other animals -- and ultimately to humans. The first we may know about it is if we get sick and the doctors find that the treatments they once used no longer have any effect. Some estimates put the number of Americans suffering from MRSA infections at 90,000 per year -- leading to nearly 20,000 deaths.

I have written many times about the misuse of antibiotics in intensive farming and the threat of antibiotic resistant bacteria (see The Defense of the Indefensible, Responsible Use of Antibiotics in Agriculture, or Antibiotics in Farming: Has Tyson Foods Shot Itself in the Foot?). Scientists and others have been warning the intensive farming industry and politicians alike of these very dangers for far too long. If this E. coli outbreak and the news of a new strain of MRSA fail to serve as a wake-up call to end the non-therapeutic use of antibiotics in U.S. farming, then we only have ourselves to blame.

The rise of antibiotic resistance has already led to a ban in the use of non-therapeutic antibiotics in a number of developed countries. The U.S. farming industry is already four years behind the European Union, 14 years behind Denmark and 24 years behind Sweden in banning the non-therapeutic use of medically important antibiotics in farm animal production. Those using and promoting intensive farming systems in the U.S. have not banned non-therapeutic use of antibiotics because such a ban would affect the way they have to farm. But isn't preserving the usefulness of medicines we depend upon more important than cheap protein?

Danish and Dutch research has shown that over time, stopping agriculture from routinely using antibiotics that are important to human health reduces the levels of resistance. All of the countries mentioned previously have taken positive action to protect the long-term effectiveness of the antibiotics their citizens need in case of bacterial illness. And contrary to what industrial agriculturalists might want you to think, the ban on non-therapeutic antibiotics has not reduced efficiency of meat production or directly increased the cost of food. In fact, one study in Denmark showed that the ban led to lower mortality and higher growth rates in pig farming.

If there can be one positive outcome of this devastating E. coli outbreak it must be to raise public awareness of the misuse of antibiotics in intensive farming systems. On March 9, Congresswoman Louise Slaughter reintroduced The Preservation of Antibiotics for Medical Treatment Act (PAMTA), which seeks to limit the overuse of antibiotics in livestock farming so these lifesaving drugs will remain effective in the treatment of human illnesses. Congresswoman Slaughter first introduced this important bill in 2009, but the issues were publicly dismissed by the intensive farming lobby and its paid-off politicians. In light of these new developments, they will find it difficult to undermine this urgent effort to introduce essential controls on these harmful activities.

Conference Report: IBIL's Annual Hugh Laddie Lecture - Legal News ...

The AmeriKat gets a twinge of nostalgia whenever she walks up Gower Street to UCL, returning to her LL.M alma mater and the scene of her first sturdy paw prints into her career in IP. Perched at the back of the lecture theatre this evening, sandwiched between a counsel and a colleague, she observed the IP glitterati as they shuffled in to this year's IBIL Annual Hugh Laddie Lecture entitled, "Killing the Goose that Laid the Golden Egg: Too Many Trademarks?" ? a lecture all about trade mark use (the bane of many a IP practitioner's existence). This year's lecture was given by The Honourable Mrs Justice Fidelma Macken of the Irish Supreme Court, and formerally Ireland's appointee on the European Court of Justice. (picture, left ? the AmeriKat during her time at UCL living in the shelf next to one of her many IP text books) Before Mrs Justice Macken began her speech, there was the matter of introductions ? all three of them! Dame Hazel Genn DEB QC, Dean of UCL Faculty of Laws (and an inspiration to this Kat) first welcomed everybody, with Sir Robin Jacob (picture, right) seconding the welcome together with a brief statement of intent now that he finds himself truly "arrived at UCL". Sir Robin stated that he wanted the function of his role at IBIL to be "not an academic IP lawyer or a solely practical IP lawyer, but something in between" with the view that IBIL is to be the institute that the IP world looks to for their views on IP goings-on. Sir Robin stated that when he tried to convince Mrs Justice Macken to speak at this year's lecture, there was really very little convincing to be done; her answer was "Yes, because of Hugh." Lord Justice Mummery, the Chairman of the evening's lecture, in introducing Mrs. Justice Macken set out her list of accomplishments and highlights ? from her educational background at Trinity College, to her work as a barrister and then as a judge first for the High Court and then as the first woman judge at the European Court of Justice. Before handing over the floor, Mummery LJ, like any good judge and chariman could not help but make some observations about the topic of trade marks: "Why should such a simple idea of having a sign to indicate the source of goods be so unpredictable??Why does a subject that is all about preventing confusion be so confusing?" Mrs Justice Macken (picture, left) in brief response, after thanking Michael Fysh and Valentine Korah (thanks!), stated that the reason that trade mark law is of great interest, annoyance and confusion is probably due to more than just Europe and the Court of Justice for the European Union (CJEU) "sticking their nose in", it is also due to the fact that it probably "pays to have a great deal of problems with IP" from the perspective of all stakeholders = the trade mark proprietors who fight to protect and strengthen their rights, the trade mark users, and of course, us lawyers. Mrs Justice Macken commenced her speech by acknowledging that "trade marks are the most wonderful things in the world apart from children, grandchildren?" and that it is a great area to work in because, she says, the philosophical reasonings underpinning trade mark law can be traced to logical (sometimes) answers in legislation. But trade marks, despite all of their merits, only function well if they are actually suitable for their job and that they are in fact used. She then regaled the audience of stories of yesteryear that when registering a trade mark in Ireland the most difficult element to prove was not the requirements for registrability but that the applicant had an intention to use the trade mark. Following a brief recap of the Community Trade Mark (CTM) story, Mrs Justice Macken criticized the Trade Mark Directive and Regulation for lacking a unified rationale and for the lack of clarity on the issue of use/non-use. Even after seven years of these instruments being in force, she said, you would think that there are few legal questions left to resolve ? not so. The criticism that was at the focus of Mrs Justice Macken's discussion was Article 15 of Council Regulation 40/94 which states: "If, within a period of five years following registration, the proprietor has not put the Community trade mark to genuine use in the Community in connection with the goods or services in respect of which it is registered, or if such use has been suspended during an uninterrupted period of five years, the Community trade mark shall be subject to the sanctions provided for in this Regulation, unless there are proper reasons for non-use." The provision, she argued, does not impose a positive obligation of use on the proprietor despite Recital 9 of the Regulation stating that there really is not much point of having a trade mark without it being used. Recital 9 states: "Whereas there is no justification for protecting Community trade marks or, as against them, any trade mark which has been registered before them, except where the trade marks are actually used" Clark & Smyth (Please help the AmeriKat out on referencing if you can!) was cited in support of the argument that Article 15 had no teeth in specifying the sanctions provided for in the regulation for non-use (i.e. Article 9) especially as it does not present a "stumbling block to registration". Mrs Justice Macken also cited an article by Shane Smyth in Intellectual Property who argued that the problem of the use/non-use issue has meant that the trade mark register is crowded with inactive marks. This is as a result of two things: First, that during registration an application can apply a mark for two or three classes of goods for the price of one (bargain!); and second, that the Nice Classification system is so broad that an application can obtain a registration for a full class of goods even though they have no intention to use the mark for a subset of that class of goods. This overly broad and crude classification is especially problematic in priority applications. For example, if the priority mark is from the US the mark is first subject to tighter registration proceedings and more restricted goods/services specifications, but as soon that mark gets to European shores their registrable class suddenly enlarges. OHIM apparently responds to these concerns by saying that there is no clutter on the register and that every year when some marks are up for renewal, a very large proportion (tens of thousands?) of marks are not renewed either for classes of goods/service or at all. Mrs Justice Macken argued that in an academic world that would be fine, but in the real world it is not attractive to be advising your client that they have to wait 10 years for that mark to come up for renewal before you can grab it. Sure, there are revocation and cancellation proceedings but they are expensive, lengthy and highly uncertain. It was suggested that it is better to advise a client to get their marketing people to find a better mark that is available, then waiting around or bringing proceedings. One would only be sensible to use revocation proceedings to oppose registration or if they are being sued for infringement and are able to use it as a defence. Mrs Justice Macken then went on to tackle the issues and comments raised in the Max Planck Institute's recent report (see here) on the European trade mark system. When the Trade Mark Directive and Regulation were originally published a joint statement was issued that stated that adequate use of a trade mark would be use of a trade mark in a single member state. Such use would then be sufficient against a non-use attack. The Max Planck report examined whether this was a justifiable approach and whether there was any feeling from concerned parties that the 5 year period for use should be reduced to 2 years. According to the report, a vast majority of practitioners and users wanted to keep the 5 year period, but the lawyers did not ? but no reasons were given for this view (Does anyone want to give any thoughts?) Mrs Justice Macken then briefly turned to the issue currently being raised in the ONEL case (supported by the VP of the Hungarian Patent Office and the Danish IPO). She stated that the reasoning behind this support is that if a trader wants to trade in a small area, like Belgium, under Mark X but has no interest in trading in Slovenia why should a trader in Slovenia who has no interest in trading in Belgium not be able to trade under Mark X? The current Community Trade Mark system does not allow this because there is a very European rationale underpinning this position, i.e., trade mark use is to be considered use for the purposes of the internal market, not merely as use as per each Member State. The joint statement can be interpreted as saying that use in one state "could be" use through out the Community, i.e., it does not necessarily have to be, but such an interpretation although logical, Mrs Justice Macken stated, is not found in the text. Mrs Justice Macken then closed by touching briefly on the issue of competition law and intellectual property ? the necessary evil the AmeriKat feels she needs to start taking seriously in her own education. She stated that with the rise in consumer protection the impact of competition law on IP is more and more intrinsically felt. Mrs Justice Macken stated that in her opinion trade marks, patents and other IP rights, provided they are not abused should not be heavily restricted by competition law because IP rights are a integral part of a functioning market ? only if they are abusive should competition law intervene. In closing, she also expressed concern that there is an automatic assumption that if a company is large, has a large IP portfolio they ipso facto are bound to abuse their IP rights; this is a falsity that Mrs. Justice Macken wishes to correct. The floor was then open for questions. Kate Szell was the first up who echoed, from experience, Mrs Justice Macken's speech. Szell stated that the cluttering of the trade mark register was a significant problem when advising clients to register especially from the "use" perspective. It is rare that a search does not reveal anything of potential concern and as a practitioner one has to advise their client that if they proceed they could be faced with an interim injunction. Szell also stated that it can also be the case that after an internet search a prior mark can seem to be limited for a class of goods, but the risk is of course still there. There is this element of risk due to the "use" problem, but if an overly-cautious approach is taken then new registrations may never occur because clients would be too reluctant to adopt a mark. The general opinion was that this state of the law is massively undesirable. Steven Jones of Baker & McKenzie clarified for the audience that the 5 year period is from date of registration, so during the application time as much as an additional 2 years can be added to this period. Therefore, during the 5+ year period the mark is "stuck like glue" and there is very little one can do to challenge it. Roland Mallinson of Taylor Wessing stated that under UK law one can attack a mark on the grounds of "bad faith" for non-use or non-intention to use the mark. Under CTM you cannot do this at pre-registration stage and Mallinson questioned whether this could be a way forward. Mrs. Justice Macken stated that she was unsure if this was practically feasible and stated that bad faith arguements can also be a huge expense (quite, says the AmeriKat, someone please define "bad faith" under the Trade Mark Act 1994 because she has yet to find anyone who can). The most interesting part of the discussion was when a member of the audience (now identified as Richard Ashmead) questioned why there is a lack of transparency regarding the observations that governments are making in respect of the ONEL case and the recent German reference on embryos. We should be able to see what the UK government is saying about these issues and that the secrecy is absurd. Mrs Justice Macken had sympathy with this position and stated that this is something that should be reviewed. This Kat absolutely agrees. How can the UK Government, or any EU Government, expect the people of their countries, including trade mark users, proprietors and practitioners to work under their trade mark law if they do not even know what their Government thinks about such issues? Why should there be such secrecy at all? These are cases that are being referred to the Court of Justice which we will eventually be bound by in some respect. Thoughts? The Annual Sir Hugh Laddie Lecture was closed by Lord Justice Mummery and the participants ventured across Gower Street for much-deserved drinks and canap?s and an evening of further topical trade mark discussions. Mrs Justice Macken's paper will be made available through the IBIL website in due course and this Kat will be greatly interested to get her paws on it for some light summer reading.
